Monsanto wins Pioneer Appeal Of Patent Dispute

Monsanto Co. has won another round in patent dispute with former chief rival Pioneer Hi-Bred International,, a federal appeals court Tuesday to strengthen patent ownership of Monsanto GM maize.

United States Court of Appeals for the Federal Circuit upheld the Board's decision in U.S. Patent and Trademark Office appeal has found a patent that the patent application is a senior Monsanto, Pioneer, while Pioneer, a DuPont business, is filed and granted before "the implementation of Monsanto's patent protection.

Monsanto in June 2005 filed a patent for GM maize, citing in particular the details of grain containing a specific DNA that could help make crops resistant to drought tolerance and resistance to stress diseases, among other features. In a separate case, two companies involved in a fierce battle in technologies for Monsanto herbicide-resistant soybeans and properties of Roundup Ready corn.

DuPont has also led federal regulators to know that Monsanto violated antitrust laws.

Both Monsanto and Pioneer have a direct comment on the decision.
